Delhi HC To Amazon: Remove Rooh Afza Not Originating From Hamdard

Bench of Justice Pratibha M Singh heard a civil suit for injunction with regard to trademark infringement of the product Roohafza whereby it was claimed that a similar product was being sold on Amazon.

The Delhi High Court, on September 5, directed e-commerce website Amazon to remove Roohafza of any other brand but of Hamdard from its database.

Bench of Justice Pratibha M Singh heard a civil suit for injunction with regard to trademark infringement of the product Roohafza.

The plaintiff company claimed that another seller had listed its product with a deceptively similar name and mark.

The plaintiffs submitted that any consumer would be confused by the deceptively similar trademark of the defendant.

The Court held that the plaintiff had made out a prima facie case for interim injunction.

Therefore, the Court directed that Amazon would remove within 48 hours any other similar product not sold by plaintiff.

Amazon was also, inter alia, asked to submit by way of an affidavit, the list of its sellers and other details.
